Welcome to Tacky Turquoise. These Terms of Service ("Terms") govern your use of tackyturquoise.com (the "Site") and any purchases made through it. By using the Site or placing an order, you agree to these Terms.

Tacky Turquoise is a trade name of Apex Quality Analytics LLC, a Colorado limited liability company ("we," "us," "our").

1. Eligibility

You must be at least 18 years old to make a purchase. By placing an order, you represent that you meet this requirement.

2. Products

We sell handmade, one-of-a-kind turquoise jewelry. Because each piece is unique:

• Once a piece is sold, it is no longer available
• Photos represent the actual piece you'll receive, but slight variations in color or pattern may appear due to monitor settings or natural stone variation
• We do not produce duplicates of sold pieces

We reserve the right to limit quantities, refuse service, correct pricing errors, and cancel orders affected by such errors at any time, including after an order has been submitted.

3. Pricing and Payment

All prices are listed in US Dollars and are exclusive of applicable sales tax, which will be calculated at checkout. We accept payment through Stripe, which processes credit and debit card transactions on our behalf. By submitting payment information, you authorize us to charge the total amount shown at checkout.

4. Order Acceptance

Submitting an order is an offer to purchase, not a guarantee of acceptance. We may decline or cancel any order, and will refund any payment in full if we do so.

6. Returns and Refunds

All sales are final. We accept returns only when a piece arrives damaged in shipping. See our Refund Policy for full details.

7. Intellectual Property

All content on the Site — including product photography, descriptions, the Tacky Turquoise name and branding — is owned by Apex Quality Analytics LLC. You may not reproduce, distribute, or use this content for commercial purposes without written permission.

8. User Conduct

You agree not to:

• Use the Site for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Site, our servers, or our backend systems
• Interfere with the Site's security features or normal operation
• Use automated tools (bots, scrapers) to access or copy the Site

9. Disclaimer of Warranties

The Site and our products are provided "as is" without warranties of any kind, express or implied, except where prohibited by law. We do not warrant that the Site will be uninterrupted, error-free, or secure.

Each piece is handmade, which means small variations in stone, bead size, and finish are part of its character and not defects.

10. Limitation of Liability

To the fullest extent permitted by law, our total liability for any claim arising from these Terms or your use of the Site is limited to the amount you paid for the affected order. We are not liable for indirect, incidental, consequential, or punitive damages.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in Montrose County, Colorado, and you consent to the personal jurisdiction of those courts.

12. Changes to These Terms

We may update these Terms at any time. The "Last updated" date at the top reflects the most recent revision. Continued use of the Site after changes constitutes acceptance of the new Terms.
